Please read these Terms and Conditions of sale carefully. By making a purchase on this site you are agreeing to the terms that appear below.

1. Terms & conditions

1.1 These Terms and Conditions of sale apply to all Abigail Edgar sales.
1.2 In these terms and conditions ‘Company’” means Abigail Edgar, ‘Customer’ means the person or company purchasing the art.
1.3 The Terms of sale are taken as the latest published terms at the time of sale.

2. Prices

2.1 The price of goods is as published on the website at time of order confirmation. This is when you have entered all delivery and payment details and are proceeding to confirm the order.
2.2 All prices are exclusive of any delivery/postage and packing charge, which is shown separately.
2.3 Abigail Edgar reserves the right to change any price by publishing the amended price on the website.

3. Payment

3.1 Payment must be made for all orders prior to any order being dispatched. Payment must be made either by credit card, debit card or PayPal.
3.2 All payment details supplied will be subject to third party (PayPal/Stripe payments) security checks, which helps eliminate fraud. All payment details supplied must be correct, otherwise we reserve the right to refuse an order for failing to adhere to basic credit card security measures. This includes providing accurate and up-to-date information, which must include the name and address of the cardholder.

4. Commissions

4.1 If you have ordered a bespoke item, payment must be made prior to the order being dispatched.
4.2 For all commissions, a minimum of half the agreed fee (minus postage and packing) must be paid before the work is started. Work will be completed on or before the mutually agreed deadline.

5. Delivery

5.1 All orders are despatched via Royal Mail or UPS according to our latest delivery charges, except for “local pick up”. Please use the contact form before requesting local pick up, to check if it’s the best option for you.
5.2 All orders will be dispatched to the delivery address supplied. For “signed-for” deliveries a signature will be required for acceptance of the order. Please let me know in advance if this will not be possible. In the event of a non-delivery due to the customer being unavailable, it is the responsibility of the customer to find a suitable alternative for delivery.
5.3 Any Express delivery options are offered as additional services, and as such they are non-refundable in the event of an order being returned. The standard delivery option as such forms part of the contract.

6. Cancellation

6.1 Customers have the right to cancel an order before it is dispatched, unless it is a bespoke item or a commission.

7. Refund and returns

7.1 Under the UK Consumer Protection (Distance Selling) Regulations 2000 you have the right to cancel. You may cancel your order in writing or by another durable medium, or by returning the products accompanied by a cancellation notice. You can do this up to 14 days from receipt of goods. It is the responsibility of the customer to ensure that the goods are returned to us in perfect condition. The costs of postage for returning the goods are the responsibility of the customer, except in the case of faulty goods. Please contact me if you would like to return something.
7.2 I am unable to accept returns or issue refunds for any bespoke orders or commissions.

8. Liability

8.1 I will not be liable to you or be deemed to be in breach of the contract by reason of any delay in performing, or any failure to perform, any of its obligations in relation to the products ordered by you if the delay or failure was due to any cause beyond its reasonable control.
8.2 While I have taken every care to ensure that the information on this website is accurate and up to date, I do not give any warranty as to its accuracy or completeness.

10.1 The contents of these pages (including pictures, designs, logos, photographs, text written and other materials) are the copyright trademark of Abigail Edgar. All rights are reserved. The copying, modification, distribution, reproduction, or incorporation into any other work of part or all of the material available on this website in any form is prohibited without approval from me.
10.2 Use of the images on this website is agreed provided that Abigail Edgar is credited. Thank you.
10.3 The contract between the Company and the Customer shall be governed by and construed in accordance with English Law

PRIVACY AND COOKIES
This policy sets out the basis upon which information is collected about you by Abigail Edgar through the use of this website. Please read the policy carefully, as by providing such data to us you have consented to the processing of such information. 

INFORMATION COLLECTED

When you use the Abigail Edgar website, we may collect personal information about you – i.e. when you use the contact form, you provide a name and email address.  

I use this information to:

  • contact you to respond to queries or send you my newsletter, for example

1.1 USER ACCOUNTS

Your information is collected (name, address) when you create a user account and log in to the shop.

1.2 PURCHASES

Information is also collected about you when you use the Abigail Edgar checkout to buy art, however all payment details are encrypted and cannot be accessed. This site uses Stripe for credit and debit cards. Stripe has been audited by a PCI-certified auditor and is certified to PCI Service Provider Level 1. This is the most stringent level of certification available in the payments industry. The Abigail Edgar site also uses PayPal which is also DCI compliant and offers additional levels of protection for the buyer.

2. USE OF COOKIES
Cookies are pieces of data that a website can transfer to an individual’s computer hard drive for record keeping. Cookies can make websites easier to use by storing information about your preferences. The information may remain on your computer after the Internet session finishes and you leave the website but you can delete them using some browsers, manually or using system utilities. Most internet browsers are pre-set to accept cookies.

If you prefer not to receive cookies, you can adjust your internet browser to refuse cookies or to warn you when cookies are being used. This site will work more efficiently if receipt of cookies is enabled but it will still operate correctly if you disable them.

DATA USE
When you join as a subscriber I collect contact information about you in order to send you newsletters, but no other data is collected or processed. I will never sell, rent or exchange your details with any other organisation.

2.2 PRIVACY AND DATA PROTECTION
Abigail Edgar complies with all applicable UK and EU data protection legislation in force in respect of any personal information you submit. This personal data will only be used for the specified purposes indicated to you and will never be passed onto any third parties (as above). You can contact me to amend or remove any information you submit. You can also unsubscribe by clicking on the relevant ‘unsubscribe’ link in my emails.

3. OTHER WEBSITES
This website may contain links to other websites which are not covered by this privacy notice. If you access other sites using the links provided, the operators of these sites may collect information from you which will be used by them in accordance with their privacy policy.
